PREAMBLE

These conditions are agreed between Mário Brites Faria, Ldª, henceforth designated as Langiarte and between any person who wishes to make a purchase through the brand's web site www.langiarte.com, telephone 249 094 354, mail, e-mail and fax, henceforth designated as "Customer".

Orders will be shipped to the Continent, Madeira and Azores, and countries of the European Union, however there may be exceptions for some European countries. If this is the case, please contact us in the "Contacts" area in the upper left corner of the site.

These conditions refer exclusively to non-traders.

The parties agree that their relations shall be governed exclusively by the general conditions described herein.

 

ARTICLE 1 - OWNERSHIP OF THE DOMAIN WWW.LANGIARTE.COM

The site www.langiarte.com is property of Mário Brites de Faria, Lda, with headquarters at Rua Foros da Lameira s/nº, in Entroncamento, registered in the Conservatória do Registo Comercial of Lisbon under the single registration and tax payer number 510 111 629, with a capital stock of 5.000,00 euros.

ARTICLE 2 – OBJECT

The present conditions have the objective of defining the general sales conditions, established between Langiarte and the Client, from the act of ordering to the various services provided by Langiarte, such as the payment methods and the merchandise delivery conditions.

These conditions regulate all the necessary steps to make the order and guarantee the follow-up of this transaction between the contracting parts.

 

ARTICLE 3 - INFORMATION ABOUT CONTENTS

The reproduction, transfer, distribution or storage of the contents of the site www.langiarte.com without prior written authorization granted by Langiarte is prohibited for other purposes other than strictly personal use.

Langiarte reserves the right to modify at any time the information and commercial offer presented about: products, prices, promotions, commercial conditions and services.

It is expressly forbidden the introduction of links from the present site, independently of the intended purpose, without prior authorization from Langiarte. The use of Langiarte.com domain with abusive purposes, and without previous authorization, is susceptible of Langiarte's recourse to the competent legal means. If you find in other sites, links that allow you to access to www.langiarte.com, we inform that Langiarte has no responsibility on the origin of the page or the content in it.

All efforts were made to ensure that the information presented here is free of typographic errors and whenever they occur, Langiarte will proceed as soon as possible to their correction.

The photos presented in this site are merely illustrative. Langiarte recommends that the customer consult the detailed description of the product in order to obtain complete information about its characteristics.

Langiarte is not responsible, direct or indirectly, for any information, content, affirmations or expressions that appear in the texts of the articles commercialized in the site www.langiarte.com. The authorship of the content of the products descriptions is responsibility of the editors, manufacturers and distributors of the articles in question.

If the information presented does not correspond to the actual characteristics of the product, the Customer is entitled to rescind the purchase and sale contract under the applicable legal terms.

Despite its efforts, some products may present an incorrect price, reason why Langiarte verifies the prices every time it processes the orders. If the price of the product is lower than the advertised price, Langiarte will refund the difference. If the price is higher, Langiarte will inform the client of such situation by email and will wait for his decision to accept the new proposal or cancel the order within 15 days from the date the client was informed.

All contractual information is written in Portuguese language, as well as the information of the articles, communications by email and formalization of the sale.

 

ARTICLE 4 – ORDER

The Customer may place his order online, at www.langiarte.com, by e-mail encomendas@langiarte.com , telephone/fax 249 094 354 or in person in our Stores.

To finalize your order the Customer must provide personal data, such as your Customer number and your name, address, postal code, city, telephone, email, VAT number, etc. To do this, the Customer must fill in all the mandatory fields of the user registration for this purpose.

By placing his or her order, the Customer expresses his or her full and complete acceptance of the general conditions of sale, the prices and the description of the products contemplated in this transaction. These general terms of sale will be the only ones applicable between the two parties.

Once 5 calendar days have passed since the order was placed and if we have not received any payment, the order will be cancelled. Payments can only be processed if the information to be used for billing can be verified.

If the product is not available Langiarte will inform the customer and reimburse any amount paid within 30 (thirty) days from the date of the unavailability.

Any dispute on this last point will be solved through an exchange of information and with the guarantees mentioned below.

 

2.1 - Tracking your Order:

To track the status of your order, the Customer may check its status in the My Orders menu, contact Langiarte's Customer Service at 249 094 354 Monday through Friday from 10:30am to 1:30pm and 3pm to 7pm, except Sundays and holidays or send an email to clientes@langiarte.com.

Orders may be in the following states:

-Payment pending

-Payment confirmed

-Preparation of the order

-Order shipped

-Order delivered

-Order cancelled

-Order refunded

 

ARTICLE 5 – DELIVERY

The delivery of the orders can be made

In one of our Stores - Langiarte - (without delivery costs):

Your order is treated as priority and you will receive a notice by e-mail informing you that your order is already available in the selected store, (keep your data updated). Proceed to the pick up, within a maximum of 15 days, accompanied by a valid Identification Document and the respective proof of purchase or order.

At your home - Cost of service: 

All shipping costs are calculated at the time of purchase, after entering your zip code. We ship to the entire European Union, with a few exceptions. If your location is not available, please contact us at clientes@langiarte.com to check shipping possibilities. 

Free shipping for orders over 30€ (Portugal Continental).

The order is delivered to your home at the address in our database. If you are not at the address you gave us, we will contact you by phone to arrange delivery or we will leave you a notice with which you can reschedule the delivery of your order.

IMPORTANT: Home delivery cannot be made to P.O. boxes.

Langiarte will deliver your order wherever you want. You only need to indicate the desired address in the online order form.

A delivery is considered made or a product is considered delivered when the delivery receipt is signed at the agreed address.

5.1- Inspection at time of delivery

Upon delivery, the customer should inspect the package for any damage. If you find that the products are damaged, you should not accept delivery of the order, which will be returned. Langiarte will refund all shipping and handling fees once the warehouse has received and completed the return process.

After receiving the order it is important that the client verifies the delivered products in a period of 15 days, because Langiarte considers that the client accepted the product(s) if he doesn't reject it in this period.

 

5.2-Returns & Cancellations

The following terms and conditions apply only to purchases made at www.langiarte.com

The Customer may cancel his order at any time until its delivery, and will be entitled to a refund of all amounts paid, except for the shipping costs of the order. From receipt of the order by the Customer, the Customer may exercise its right of free withdrawal under the terms legally provided for and indicated below, namely in Decree Law No. 24/2014 of February 14.

Non-payment of the order within 10 (ten) days following the date on which it was definitely placed implies automatic cancellation of the order.

In accordance with the provisions of Decree Law No. 7/2004 of January 7 (as amended by Decree Law No. 62/2009 of March 10 and Law No. 46/2012 of August 29) on electronic commerce, Langiarte reserves the right to unilaterally cancel the order when there is a programming error, malfunction of Langiarte's computers as well as if the contract proposal arrives deformed at its destination and the error affects an essential element of the contract.

In order to exercise his right of free resolution, the Client must communicate, in any Langiarte store or in the Langiarte.com Customer Service, his decision to terminate the present contract by an unequivocal statement (for example, letter sent by mail, fax or e-mail).

 If you wish, you may also fill in and submit electronically the model free withdrawal form or any other unequivocal declaration of withdrawal via the website www.langiarte.com. If you make use of this possibility, Langiarte will send you within 24 (twenty-four) hours, on a durable medium (e.g. by email), an acknowledgement of receipt of the withdrawal request.

 In order to respect the period of free resolution, it is sufficient that your communication concerning the exercise of the right of free resolution is sent to Langiarte before the expiration of the resolution period.

These refunds will be made using the same means of payment used by the Client in the initial transaction, unless otherwise expressly agreed between the parties; in any case, the Client does not incur any costs as a consequence of such refund.

Langiarte hereby informs you that it may withhold the refund until it has received the returned goods, or until the customer provides proof of shipment of the goods, whichever occurs first.

 The client must return the goods without undue delay and no later than 14 (fourteen) days from the day he/she informed Langiarte of the free termination of the contract, this period will be respected if the client returns the goods before the expiration of this 14 (fourteen) days.

The Customer must bear the full cost of returning the goods in case of exercise of the right of free termination of the contract, in the case of return of goods that by their nature cannot be returned normally by mail, the Customer must bear the direct costs of that return which are associated with the shipping costs that are listed in the table of shipping costs of orders.

If the Client wishes to exchange articles, he/she can go to any Langiarte store, or contact the langiarte.com Customer Support, which will provide all the information about the exchange process. The Client should not, in any case, send the articles to Langiarte without a previous contact, because they will not be received.

When returning or exchanging articles the client must respect the following conditions:

Return of the articles in good condition, with complete original packaging and accompanied by the respective original invoice;

The telephone support services hired by the Customers are not liable to reimbursement of the amounts paid;

After contact with langiarte.com Customer Support and be given the return instructions, you can send us the item properly packed, with original packaging to the following address:

All items will be checked upon arrival at our service and will only be accepted for exchange or return those that respect the return conditions.

In case of return, if the client chooses to be refunded, Langiarte informs that:

The refund is made by the same means of payment or in Langiarte gift check, according to the will manifested by the Client. In case of return of an article paid with Gift Check, the value will be reimbursed through a new sending of Langiarte Gift Check. In case of payment by ATM, Langiarte will ask the client to provide a Bank Identification Number (IBAN) so the return can be done faster.

In the eventuality of having received damaged articles or with technical problems, Langiarte will schedule the collection of those articles at the place you indicate us, in the same area of the original order, without any charges for the client.

The reimbursement or exchange will only be done after the verification of the product's condition.

Langiarte reserves the right not to accept items that do not meet these conditions.

5.2.1 - Order cancellation before shipping

The customer can cancel an order, as long as it has not yet been sent. If the customer makes an order and wants to cancel it, he must first check the status of the order through the My Orders menu at the bottom of the main page of the site. And if the order status mentions "Registered" there is a possibility that it can still be cancelled. However, the customer should contact our Customer Service and ask for the cancellation of his order. Only after this procedure is it possible for our Customer Service Department to request our warehouse to cancel the order.

If the cancellation request is successful, the customer will be notified by e-mail of this decision and the cancellation will be processed at no cost to the customer. If the cancellation request is not possible, the products will be sent to the customer, who, in case he maintains his intention to cancel the order, should refuse to receive them. The products will be returned and, after reception, the chargeback will be processed.

5.2.2 - Return of defective products

The customer has the right to return delivered products if they are found to have defects or other non-conformities with the products ordered. The return can be made within 30 days of receipt of the order. This does not affect your statutory rights. If your complaint is justified, the price and shipping costs will be refunded. For more information on how to proceed with the return and information on the chargeback, please consult the FAQ's section of the site or the My return credits menu in the Customer Area of the site (My account).

5.2.3 - Return of products due to withdrawal

If for any reason you are not satisfied with the products you ordered you can return them within 14 days after the delivery date (if the end of the period is a holiday, the deadline will be extended to the next working day), provided that

  • The products have not been washed or used (unless the product contains information to the contrary, the customer has the right to try them on to test the size and shape, but cannot use them, just as if they were in a physical store);

The product retains its original features and the packaging is undamaged (carefully opened packaging will not be considered damaged);

  • The product is complete (e.g. both items of a pair have to be returned);

5.2.4 - Returning gifts

Currently it is not possible for a person who received a product as a gift from another person to return it. In this case, to return it, you should contact the person who bought it, so that they can return it (according to 5.2.2 and 5.2.3)

5.2.5 - Product exchange

Currently it is not allowed to exchange products, only exchange by size or color. However, the customer has the option of returning products. If you want to order another color or another article you will have to make a new order in the online store.

5.2.6 - Return information

In case your return is justified by a defect or non-conformity with the ordered products, Langiarte will pay for the return shipping costs. If your return is not based on a defect or non-conformity of the ordered products, Langiarte will not refund the shipping costs. However, when making a return you will be using our shipping provider. As the costs incurred by Langiarte to make the return are equal to the shipping costs, Langiarte will not refund the shipping costs initially incurred by the customer for their order.

Refunds will be made based on the method of payment. If the customer has paid by ATM*, credit card or cash** it is necessary that the customer gives his bank details to our Customer Support at the time he initiates the refund process. In the case of a check, the refund will only occur after good collection (of the same), being also necessary information of the account to credit. This information is necessary so that we can proceed with the refund (reversal) of the money to your account. The customer will receive the refund after the product(s) have been returned and processed.

ARTICLE 6 – PAYMENT

Langiarte offers the Client several payment methods:

- Credit Card (Visa and Mastercard):

The data of the order and your card will be sent, properly encrypted, to the banking entity on the date of your order. Only after validation and communication from your bank, the order will be processed.

- ATM:

The Customer will pay a lump sum corresponding to the costs of handling the order. The additional charges are composed of fixed expenses as a share in the packaging and shipping costs and optional expenses in case you choose the payment method upon receipt of the order, unless you benefit from a special offer that will exempt you from such payment.

- MBWAY:

The Customer will pay a lump sum corresponding to the costs of handling the order. The additional expenses are composed of fixed costs as a share in the packaging and shipping costs and optional expenses in case you choose the payment method upon receipt of the order, unless you benefit from a special offer that will exempt you from such payment.

- Bank Transfer:

 The Customer will pay a lump sum corresponding to the costs of handling the order. The additional expenses are composed of fixed costs as a share in the packaging and shipping costs and optional expenses in case you choose the payment method upon receipt of the order, unless you benefit from a special offer that will exempt you from such payment.

You must send within 48 hours the respective proof of payment to clientes@langiarte.com.

6.1 - Reservation of Ownership

Langiarte retains ownership of the company's products until it has received full payment for all such products.

6.2 - Payment Security

The www.langiarte.com store uses one of the most robust security technologies among available encryption platforms.

Your payment information will be encrypted from the moment you enter until your transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the Internet or via email cannot be guaranteed. Langiarte shall not be liable for any damages suffered as a result of the use of electronic means of communication including, but not limited to, damages arising from failure or delay in the delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for communications or virus transmissions.

 

ARTICLE 7 – PRICES

Prices are to be understood in euros, taxes and fees included. The prices shown take into account the VAT applicable on the day of the order. Any change in the type of VAT applicable will be reflected in product prices. After this date, prices may be modified at any time.

Prices and specifications are subject to change without notice. Langiarte declines any responsibility for any errors published on the Site. During the treatment of your order any price error that may be presented on the site due to technical anomalies will be detected. In this situation the client will be contacted. If the price of the product displayed on the Site is actually lower, the difference is returned. If the price is higher, the customer will be contacted and may accept or cancel the order.

 

ARTICLE 8 – GUARANTEES

Langiarte does not sell second hand, defective or inferior quality products. The main characteristics of each product shown on www.langiarte.com can be found on each product page.

The products offered for sale on Langiarte's site may not exactly match the actual apparel in terms of image and colors due to the internet browser and monitor used.

All products have an identification label. Please do not remove the label from your purchased product if you wish to return it.

Should you decide to exercise your right to return purchased products, Langiarte has the right not to accept the return of products that are returned without the label or that have been altered from their original condition or damaged.

All items can be exchanged or refunded except those that have a statement to the contrary and when kept in their original packaging without being opened or damaged (see 5.2 - Returns & Cancellations).

The exchange or refund request must be made within 15 (fifteen) days after the reception date.

In case of exchange, if the new order has a higher cost, the customer will have to pay the difference, adding to the exchange request the payment of the remaining amount or making it when picking up the new order.

In the case of a refund request of an article bought with a reduced price, due to a special offer, Langiarte will refund the amount effectively paid by the User and not the totality.

The exchange of articles of intimate use cannot be made in certain cases according to the law.

In all cases, all the exchange or refund request must be done by post to Langiarte (address), or you can send us your return through a Langiarte Store, filling the PDF form (on the site) (with name, complete address, telephone, email, client number, order number, invoice number and indicating the references of the articles and the reasons of the return) and attaching it to the return. All items are covered by a contractual warranty, without prejudice to the legal warranty.

The legal guarantee also applies to any lack of conformity resulting from the packaging.

8.1 - AFTER-SALES SERVICE AND MANUFACTURER'S WARRANTY:

The costs with the return or collection of the articles within the period of the guarantee, will be supported by Langiarte.

 

ARTICLE 9 - RESPONSIBILITY

For all the access steps to the Site, from the order process, to the delivery or the subsequent services, Langiarte only has an obligation of means. Langiarte excludes all guarantee and any responsibility for the inconveniences or damages inherent to the use of the Internet network, in particular, a service disruption, an external intrusion or the presence of computer viruses, or any case of force majeure so classified by the jurisprudence of the courts, to the extent permitted by the applicable law.

The items sold are described and presented on the Site as accurately as possible. If, despite all of our precautions, errors occur on the Site or in Langiarte's catalogs, Langiarte will not be held responsible. Except in the case of a guarantee, any transaction between Langiarte and its Customers, which is not contested within 6 months, will not be subject to any claim.

 

ARTICLE 10 - OBLIGATIONS OF THE CLIENTS AND USERS

The Client and the User undertake to comply with and respect these General Conditions of Contract and Use, namely:

1) To refrain from introducing, storing or disseminating through the site defamatory, obscene, injurious, xenophobic and/or any other content that violates the general principles of law and public order;

2) To keep, and not disclose, your password to enter the site in order to prevent third parties from accessing your Langiarte.com account;

3) Not to use false identities;

4) To provide the correct personal information and addresses so that Langiarte can properly process the orders.

Its users are expressly forbidden to transmit messages or injurious information, deceitful, defamatory, obscene or that violates, in any way, the right to privacy or intellectual or industrial property of others, as well as the availability of any information that can be harmful to third parties or to the owner of the site.

Langiarte reserves the right to delete the account of the user that materializes any of these situations.

The client is responsible for the veracity of the data reported to Langiarte and agrees to immediately insert in his account on the site www.langiarte.com, any changes to the same.

Langiarte declines any responsibility for any eventual delay or impossibility to process the order, namely in the act of delivery, due to error or insufficiency of the data communicated by the client.

 

ARTICLE 11 – HANDLING OF PERSONAL DATA

The computerized treatment of the data collected is done in compliance with the legislation on data protection and the same are intended for sending orders, administrative support, statistics and future presentation of new proposals by Langiarte. The data collected may be communicated to third parties of recognized competence for direct marketing purposes. If you oppose to this, you only need to contact us with your name, surname, address and customer number. The Client is guaranteed, under the terms of the law, the right to access and rectify any data concerning him/her contained in the database, by writing to:

You can access and modify your data at any time in "My account".

Although Langiarte collects and processes data in a secure way to prevent its loss or manipulation, using the most advanced techniques for this purpose, we inform you that the collection in open networks allows the circulation of personal data without security conditions, running the risk of being seen and used by unauthorized third parties. The user authorizes Langiarte to treat the personal data provided in an automated way, in particular by the use of cookies.

 

11.1 - USE OF COOKIES

Cookies are small text files sent by the websites you visit and stored on your computer. They are widely used for the operation of websites, or to increase their efficiency, as well as to provide information to the owners of the site.

Langiarte uses cookies to collect information about how visitors use its website. We use the information to create reports and to help us improve the site. Cookies collect information in an anonymous form, including the number of visitors, the sites from which they come, and the pages they visit.

It is given the designation of Langiarte Newsletter, to the e-mailings, promotional offers, and to the institutional newsletters, information about the company or the Client, sent directly to the Client's e-mail box. The Client has the possibility to subscribe to the Newsletter, being automatically registered from the moment he makes his first order or his first registration. You can access and modify your data at any time at “My Personal Information” and manage your newsletter subscription by checking "Subscribe to our newsletter!" and "Receive offers from our brands!

Langiarte's Newsletter is an exclusive of Langiarte's Internet Site.

 

ARTICLE 13- INTELLECTUAL PROPERTY

All elements of the Langiarte Site, whether visual or audio, including the underlying technology, are protected by copyright, trademark or patent rights. They are exclusive property of Langiarte. The Client that has a personal Site on the Internet and wish to put, for personal use, in his Site, a simple direct link to the home page of Langiarte's Site, must request Langiarte's authorization. This is not an implicit agreement of affiliation or partnership. On the other hand, any hypertext link to Langiarte's Site using the framing technique or in-line linking is formally prohibited.

In all cases, any link, even tacitly authorized, must be removed with a simple request from Langiarte.

 

ARTICLE 14 - TOTAL AGREEMENT

These general conditions of sale constitute the entire agreement between the parties concerned.

Should any of the clauses in these conditions become null and void as a result of a legislative or regulatory change or by judgment, this shall in no case affect their validity and compliance.

 

ARTICLE 15 – DURATION

The present conditions apply throughout the duration of the services offered by Langiarte. All the articles of the Autumn-Winter collections online are valid until the 30th/04 of the following year, within the limit of the available stocks.

All the articles of the Spring-Summer collections online are valid until October 30th of the same year, within the limit of the available stocks. All articles exclusive to the site are valid until the limit of available stocks.

 

ARTICLE 16– EVIDENCE

The computerized records, kept in Langiarte's computer systems in secure conditions are considered as a proof of the communications, orders and payments produced between the parties.

 

ARTICLE 17– PRESERVATION AND ARCHIVING OF TRANSACTIONS

Orders and invoices will be archived on a reliable and durable medium to correspond to a true and durable copy.

 

ARTICLE 18 – APPLICABLE LAW AND JURISDICTION

Portuguese Law shall apply to the conditions of sale presented.

Failing resolution by agreement between the parties, any dispute arising from these General Conditions of Sale shall be submitted to the competent Portuguese court.

19.2 - What is personal data?

It's any information, of any nature and independently of the respective support, related to a natural person, directly or indirectly, identified or identifiable (data owner).

The servers are outsourced but Langiarte requires that they guarantee a high level of security, confidentiality and adequate protection of privacy and fundamental rights required by the European Union. However, we do not control all the risks related to the use of the Internet, alerting you to the existence of possible risks associated with its use and operation, and consequently the sharing of personal data by this means.

19.5 - Commercial Offers and Communications

Langiarte may make you commercial offers by e-mail, namely, sending discount vouchers, birthday offers, viewed products and for the evaluation of products purchased from Langiarte. In the case of sending an email, the sender Langiarte will be clearly identified and the nature of the communication will be indicated in the subject of the message. At the end of each message, you will have the possibility to cancel our emails.

19.6 - Period of conservation of personal data

Langiarte retains personal data during the retention periods identified above and only for the period of time necessary, or for the fulfillment of obligations to which it is legally subject.
